-  What is Xtreme Dimensions' (XD) copyright information?

1.  Copyright © 2004-2005 Xtreme Dimensions. All Rights Reserved.

2.  All XD logos, products, graphics, and various other files, both on and off this web site, are protected by this copyright notice.

3.  My copyright notice is posted at the bottom of my web site.

-  What are you allowed to do with (permitted use) material belonging to XD?

1.  Once you have obtained my written permission, you may copy or distribute my products, as identified in the written permission notice.

2.  You may make fair use of certain copyrighted materials that I have designated as advertising and promotional materials. Fair use means that you are using my materials to refer to my products and services. Fair use is possible without my permission, provided you follow standard copyright usage practices and provide proper attribution.

3.  Any other uses require written permission from XD, specifically from Donna Howell. You can make such requests by contacting me through the communications technologies on my support web page. I will evaluate your request and reply back to you with my decision as soon as possible.

-  What are you not allowed to do (prohibited use) with material belonging to XD?

1.  You may not use material, whether design or word marks, belonging to XD; except that which is specifically designated for use as listed above.

2.  You may not use material belonging to XD in, as, or as part of your own copyrights.

3.  You may not use material belonging to XD to identify products or services that are not the property of XD.

4.  You may not use material belonging to XD in a manner likely to cause confusion regarding this web site, myself or XD as a whole.

5.  You may not use XD materials in a manner that inaccurately implies that I sponsor, endorse, or am otherwise connected with your own activities, products, and services.

-  What are the rules for downloading and using my software?

1.  All software and accompanying documentation made available for download from this web site are copyrighted by XD, unless otherwise specified.

2.  Ownership of said software and documentation is retained by XD.

3.  Downloading my products indicates your agreement with my licensing terms. Please read the license agreement that is posted on each product download page.

4.  The copyright information and license terms for each product are also included in the product .zip file; in the event that you need to review them.

5.  Additional information, if any, on downloading my software will be posted on the product's download page.

XD Bullet   Privacy Policy

-  What personal information does XD gather, use and disseminate?

1.  XD does not sell, trade, exchange or otherwise make available any personally identifiable information to any other web site, webmaster, member, visitor, company or organization.

2.  I believe in supporting the privacy rights of others and make great efforts to protect information shared here at XD.

3.  Some forms on the XD web site may require visitors to provide their contact information (i.e. names and email addresses). Those forms notify visitors on what actions will be taken with their information.

4.  Occasionally, visitors who join a mailing list hosted by XD may receive an email that contains information that is specified at the time they join (i.e. Program Updates), or other important information regarding XD that impacts that particular mailing list.

5.  I do not collect email addresses of visitors who email me, except for any mailing lists that XD may host as described above.

6.  Input received from my customers will be used to build FAQs, testimonials, and wish list web pages. Names and email addresses of these customers will only be posted if expressly released by the customer via email or another form of written permission.

7.  Email addresses obtained from inquiries and comments that I receive are kept long enough to reply to the inquiries or comments; then they are discarded. Exceptions to this process are those email addresses that belong to new friends I meet; those addresses are maintained in my personal contacts list.

8.  Email addresses posted on this web site (see item 6 above) are placed in a special JavaScript to prevent web spiders from harvesting the email addresses for SPAM lists. Currently, guest book entries are not protected using this method.

-  What about security, off-site links and other privacy issues that affect XD and its visitors?

1.  XD is not responsible for any material hosted on external (off-site) web pages.

2.  My privacy policy extends only to those pages within the XD web site.

3.  My web service provider is not responsible for my privacy policy, the content of my web site, nor any other web sites to which my web site is linked.

4.  XD, and the server on which it is hosted, have certain security measures in place to protect the loss, misuse, or alteration of the information under our control. Even so, accessing web sites on the Internet exposes any and all web surfers to a certain amount of security risks.

5.  Use of this web site constitutes your understanding of the potential risks inherent to web site interaction; and your agreement that XD, and my web service provider, are not responsible for the loss, misuse, or alteration of information you submit; nor are we responsible for any possible damage to your computer equipment.

6.  XD will not try to get, or store, any information from your computer. I will not trace your actions on the Internet. However, I reserve the right to store the necessary information to properly calculate statistics; this means visits, hits, IP-address, browser type, etc. All this information is only used internally by XD.

This is my Freeware Software License Agreement, which applies to all software products available for download from Xtreme Dimensions web site, unless the software is labeled as something other than freeware. All software available for download via the Xtreme Dimensions web site are copyrighted by Donna Howell unless otherwise stated. Copyright law protects this software program and any associated material. Donna Howell retains title to and ownership in the copyright of the software program and the associated materials. This software is not provided as public domain software.

-  Freeware License Rights

All software products available for download from associated web site, unless labeled otherwise, are provided as freeware. Freeware products are provided free of charge. Occasionally the copyright holder may post a request for a donation in support of this software. This type of request does not change the classification of this software as freeware. Freeware software may be used as many times as you like, for as long as you like. The copyright holder reserves the right to reclassify this software as a non-freeware product at a later date (i.e. shareware of public domain). Doing so will not modify the license agreement of previously distributed executables.

-  Freeware Distribution Rights

You may distribute copies of this program provided you keep this copyright notice and the disclaimer of warranty intact. A copy of this copyright notice is included in every Xtreme Dimensions freeware package. You must not charge money or fees for the software product to anyone. The software product will not be included in/on any medium as part of a package that generates revenue and/or profit. If you offer the software as a download from your web site, you must include this license with each distributed copy of the program.

-  Code Distribution

You will not decompile, disassemble, modify, enhance, reverse engineer or otherwise alter the software from its current state. Further, you are not authorized to distribute the source code for the software.

-  Misrepresentation

You will not misrepresent yourself as the author, and/or copyright owner, of the software. You do not have any proprietary rights in and to the software. You acknowledge and agree that the Licensor retains all copyrights and other proprietary rights in and to the software.
